IMPORTANT NOTICE REGARDING RFP No. NP-13518 CTMC:
Notwithstanding anything to the contrary contained in the Request for Development Proposals (RFP No. NP-13518), in order to facilitate and expedite the transaction, staff may elect not to enter into exclusive negotiations pursuant to an Exclusive Negotiation Agreement (ENA) but instead may proceed directly to the negotiation of either a DDA or a Purchase and Sale Agreement or both with the recommended proposer (i.e. the proposer that scores the highest on the final evaluation), in which case a deposit of at least One Hundred Thousand Dollars ($100,000.) will be required to be paid by the selected Development Team at the time of its execution of either the DDA or the Purchase and Sale Agreement. Such deposit will be non-refundable to the extent provided in such DDA or Purchase and Sale Agreement. Further, staff may simultaneously negotiate a DDA or a Purchase and Sale Agreement or both with the second highest scoring proposer to be used if the highest scoring proposer does not timely execute a DDA or Purchase and Sale Agreement. Staff may present the second highest scoring proposer’s DDA or Purchase and Sale Agreement to the CRA/LA Board of Commissioners for approval fifteen (15) days after its written notice to the highest scoring proposer of its intent to do so. The highest scoring proposers shall then have ten (10) days from the date of such notice to execute the requested DDA and Purchase and Sale Agreement and deposit the requisite funds or the CRA/LA may proceed to consummate the transaction with the second highest scoring proposer.
